Property and Evidence
The personnel in our Property and Evidence unit are non-sworn civilian employees with specialized training in property and evidence management. They perform a wide variety of technical and professional duties responsible for the intake, storage and control of all property confiscated, seized, or otherwise taken into custody by any authorized personnel of this department.
Release of Property and Evidence
Items are booked into Property and Evidence under the following categories:
1. Evidence – Items collected and/or associated with a crime. Evidence is retained until a final disposition has been determined by the Court (dismissal, conviction, etc.) involving all parties charged in the case. Evidence can only be released with a County Court Order. To inquire regarding the status of a criminal case or obtaining a court order for property retrieval, contact the Dallas County Criminal District Attorney’s Office at (214)653-3600.
2. Safekeeping – Items taken and stored with the intent to return the property to its rightful owner. For example, if you have a vehicle accident and need to be transported to the hospital, Officers will secure your valuable personal property (i.e. laptop, jewelry, firearm) in Property and Evidence for Safekeeping. If after proper notification and 90 days, you fail to retrieve your property, the property will be destroyed or auctioned. (CCP 18.17)
3. Found – Items found or abandoned. For items found with a known owner, proper notification will be made. If after 90 days the property is unclaimed, the property will be destroyed or auctioned. Property with no known owner can be destroyed or auctioned 30 days after receipt of the property. (CCP 18.17)

If you believe any of these items belong to you, please contact Property and Evidence at (972) 721-2688 or ipdproproom@cityofirving.org to identify your property. You will need to provide proof of ownership to make a claim.
If you would like to report lost property, you may do so by filing a report online.
Photo identification is required for receipt of all property.
Acceptable forms of ID are:
- Any government issued ID
- Student ID
- State issued ID
- Inmate ID
- Passports
If you are unable to pick up your property and would like to designate another person to do so, fill out the Release Property to Designee Form. The form must be signed by a Notary before it will be excepted by property personnel.
Property will not be released to juveniles. Juveniles MUST be accompanied by a parent or legal guardian before property will be released.
Firearm Release Process
The process for releasing a firearm depends on why it is being held in police custody.
1. Firearm Held as Evidence
- A court order must be obtained for release on all weapons-related charges.
2. Firearm Held for Safekeeping or Found Property
Requirements:
- Disposition for the release of property (by an Officer or Investigator)
- Proof of ownership (sales receipt, bill of sale, etc.)
3. Firearm Held for Safeguard
(Texas Health and Safety Code §573.001 / Code of Criminal Procedure Art. 18.191)
a. If you are the owner detained under this section:
- Clearance from mental health court
- Clearance from the Department Legal Advisor
- Disposition for the release of property (by an Investigator)
- Proof of ownership (sales receipt, bill of sale, etc.)
b. If you are the owner detained under this section and wish to release the firearm to a designee:
Required forms must be completed and notarized by both the owner and the designee:
- Release to Designee or Transfer of Ownership Affidavit
- Disposition for the release of property (by an Investigator)
- Proof of ownership (sales receipt, bill of sale, etc.)
c. If you are the owner of a firearm seized from someone else detained under this section:
- Disposition for the release of property (by an Investigator)
- Proof of ownership (sales receipt, bill of sale, etc.)
Important Notice
Every individual collecting a firearm must pass a criminal background check before the firearm will be released. No exceptions. All firearms are released in accordance with Federal and State firearm laws.
